you agree that juicytrade shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. if there is a dispute between participants on this site, or between users and any third party, you understand and agree that juicytrade is under no obligation to become involved. in the event that you have a dispute with one or more other users, you hereby release juicytrade, its officers, employees, agents and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and/or our service. if you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor."

you agree not to post, email, or otherwise make available Content:

i) that contains any form of advertising or solicitation or email to juicytrade users who have not indicated in writing that it is ok to contact them about other services, products or commercial interests.

j) that contains any illegal services prohibited by any applicable law.

k) that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; for juicytrade or users of juicytrade.

l) that disrupts the normal flow of dialogue with an excessive amount of Content (flooding attack) to the Service, or that otherwise negatively affects other users' ability to use the Service; or

m) that employs misleading email addresses, or forged headers or otherwise manipulated identifiers in order to disguise the origin of Content transmitted through the Service.

additionally, you agree not to: n) contact anyone who has asked not to be contacted;

o) "stalk" or harass anyone;

p) collect personal data about other users for commercial or unlawful purposes;

q) use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from the Service;

r) post irrelevant Content, repeatedly post the same or similar Content or otherwise impose an unreasonable or disproportionately large load on our infrastructure;

s) attempt to gain unauthorized access to juicytrade's computer systems or engage in any activity that disrupts or impairs the functionality of, the Service or the juicytrade website; or

t) use any form of automated device or computer program that enables the submission of postings on juicytrade without each posting being manually entered by the author thereof (an "automated posting device").

any unauthorized use of juicytrade computer systems is a violation of the Terms and certain federal and state laws, including without limitation the Computer Fraud and Abuse Act (18 U.S.C. § 1030 et seq.), Section 502 of the California Penal Code and Section 17538.45 of the California Business and Professions Code. such violations may subject the sender and his or her agents to civil and criminal penalties.

if you observe any violations of Content or Terms on the Site, please kindly report by emailing us.

you acknowledge that juicytrade may, in its sole discretion, remove or delete your Content that is made available through the service. in addition, duration that the Content will be displayed or stored via the Site is set and changed by juicytrade, in its sole discretion. juicytrade holds no responsibility or liability of any kind to you or to any third party if the Content is not displayed, or is removed, deleted or distorted in any way after the Content is posted on juicytrade. juicytrade does not guarantee the availability of the Service and you acknowledge that juicytrade would not hold any responsibility or liability of any kind to you or to any third party if the Service is not available at anytime or your Content or other Content posted by other users are not available via the Service or the Site.

you agree that juicytrade has the right (but not the obligation) to delete or deactivate your account, block your email or IP address, or otherwise terminate your access to the Service immediately and without notice, and remove and discard any Content within the Service, for any reason. you agree that juicytrade shall not be liable to you or any third-party for any termination of your access to the Service. you agree not to attempt to use the Service after said termination.

any reproduction, modification, creation of derivative works or redistribution of the site is prohibited without the express written consent of juicytrade. you agree not to reproduce, Content from the Service without the express written consent of juicytrade. you may not reverse engineer or attempt to discover any source code contained in the Service. you agree not to reproduce, or exploit for any commercial purposes, any aspect of the Service.

juicytrade MAKES NO WARRANTY THAT THE SERVICE WILL MEET USER'S REQUIREMENTS, THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR FREE, OR VIRUS FREE; NOR DOES juicytrade MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED FROM THE SERVICE.

USER UNDERSTANDS AND AGREES THAT OBTAINING ANY INFORMATION OR MATERIAL AND/OR GOODS OR SERVICES THROUGH THE SERVICE IS DONE AT USER'S OWN DISCRETION AND RISK AND THAT USER WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE RESULTING FROM ANY TRANSACTION.

USER FURTHER AGREES THAT juicytrade SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM INTERRUPTION, SUSPENSION OR TERMINATION OF SERVICE, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, SPECIAL CONSEQUENTIAL OR EXEMPLARY DAMAGES, WHETHER SUCH INTERRUPTION, SUSPENSION OR TERMINATION WAS JUSTIFIED OR NOT, NEGLIGENT OR INTENTIONAL, INADVERTENT OR ADVERTENT. USER AGREES THAT juicytrade SHALL NOT BE RESPONSIBLE OR LIABLE TO USER, OR ANYONE, FOR THE STATEMENTS OR CONDUCT OF ANY THIRD PARTY. In no event shall juicytrade total liability to You for all damages, losses, and causes of action exceed the amount paid by You to juicytrade, if any, that is related to the cause of action.

Some jurisdictions do not allow the limitation or exclusion of warranties or of liability for incidental or consequential damages so some of the above may not apply to You.

You agree to defend, indemnify and hold juicytrade and (as applicable) its officers, directors, employees, agents, parents, subsidiaries, partners and affiliates harmless against any and all claims made by or liabilities to any third party resulting from any activities conducted under Your Account, Your use or misuse of the Site, including, but not limited to, posting content on the Website, entering into transactions with other Website users, contacting others as a result of their posting(s) on the Website, infringing a third party's intellectual property or other rights, failing to deliver goods or payment to other Website users or otherwise arising out of Your breach of any Terms of this Agreement.

the Terms and the relationship between you and juicytrade shall be governed by the laws of the State of California without regard to its conflict of law provisions. You and juicytrade agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Marin, California. The failure of juicytrade to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms shall remain in full force and effect.

User agrees that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the service or the these Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred.
